Waivers-
The Immigration Act and Regulations make provision for the Minister of the Department of Home Affairs upon an application made in the prescribed manner to waive any prescribed form or requirements.
This allows foreign nationals who have good reasons due to individual, corporate or personal circumstances and grounds as to why they cannot or do not need to comply with the prescribed form or requirement the opportunity to have such waived.
If successful the Department of Home Affairs will issue a letter confirming that the applicant or foreign national does not need to comply with the specific form or requirement which may then be used on the desired visa or permit application they intend to apply for in lieu of the form or requirement that was waived.
Exemptions-
Temporary residence exemptions:
The Minister of the Department of Home Affairs may allow foreign nationals to be admitted to and sojourn in the South Africa, provided that such foreigners does not intend to reside in the Republic permanently.
Permanent residence exemptions:
The Minister of the Department of Home Affairs may allow foreign nationals the rights of permanent residence for a specified or unspecified period when special circumstances exist which would justify such a decision.
